REGULAR MEETING MINUTES
APRIL 14, 2009
Supervisor Behnke called the meeting to order at 7:00 PM at the Pennfield Middle School cafeteria. Present were Supervisor Behnke, Clerk Case, Treasurer Phillips and Trustees Bartlett, Beard, Bordine-Houseman and Ensign. There were 19 residents present. A moment of silence was observed and Supervisor Behnke led the Pledge of Allegiance.
PRESENTATIONS/PROCLAMATIONS
Supervisor Behnke presented the following proclamation to Suzanne Horsfall from the Substance Abuse Council:

APRIL IS ALCOHOL AWARENESS MONTH
“PARENTS WHO HOST LOSE THE MOST-DON’T BE A PARTY TO TEENAGE DRINKING”
WHEREAS, alcohol use by young people is dangerous, not only because of the risks associated with
acute impairment, but also because of the threat to their long-term development and well being, and
WHEREAS, it is illegal to give or allow your teen’s friend to drink alcohol in your home, even with their parents’ permission, and
WHEREAS, anyone found guilty of providing alcohol to youth can face up to a $1,000.00 fine and sixty days in jail, in addition to any civil action that can be brought as a result of damages or injury related to the offense, and
WHEREAS, each year about 1,900 persons who are under 21 die in motor vehicle crashes that involve underage drinking; and
WHEREAS, alcohol is also involved in about 1,600 homicides and 300 suicides each year among persons under 21; and
WHEREAS, alcohol abuse is linked to as many as two-thirds of all sexual assaults and date rapes of teens and college students and is a major factor in unprotected sex among youth, increasing their risk of contracting HIV or other transmitted diseases; and
WHEREAS, 13 percent of all youth, ages 12-17, had at least one serious problem related to drinking in the past year;
• The Underage Drinking Prevention Forum of the Substance Abuse Council
launched the campaign “Parents who Host, Lose the Most: Don’t be a party
to teenage drinking: at a Media Conference on March 23rd at 4:00 PM at
Lakeview Square Mall
• Local leaders and alcohol free youth throughout the county are invited to be
part of the solution by volunteering to teach a lesson on alcohol to 5th grade
students throughout the county, during April or May. The Substance Abuse
Council will provide training and materials for “Teach-In” presenters upon request.
• The Underage Drinking Prevention Forum of the Substance Abuse Council
will present garden plaques in April to local youth groups that planted red
tulip bulbs which will bloom this spring and serve as a reminder to keep
Calhoun County Youth alcohol free.
WHEREAS, the Substance Abuse Council, through April Alcohol Awareness, “Parents who Host, Lose
the Most; Don’t be a party to teenage drinking” campaign provides the education materials to raise community awareness regarding this illegal and unhealthy practice, and
WHEREAS, the Pennfield Charter Township Board of Trustees encourages residents to refuse to provide alcoholic beverage to underage youth and to take the necessary steps to discourage the illegal and unhealthy practice, including the reporting of underage drinking by calling their local law enforcement, and
NOW THEREFORE BE IT RESOLVED, that the Pennfield Charter Township Board of Trustees not only discourages the use of alcohol by those below the legal age of consumption but also exhorts all residents of Pennfield Charter Township to refuse to provide alcoholic beverage to those underage youth, and will continue to take the necessary steps to discourage this illegal and unhealthy activity.

SEXUAL ASSAULT AWARENESS MONTH
WHEREAS, the month of April, 2009 has been designated as National Sexual Assault
Awareness Month; and
WHEREAS, only 40 percent of rapes and sexual assaults are reported to law
enforcement; and
WHEREAS, among female victims of rape and sexual assault, 74 percent of the crimes
were committed by intimate partners, relatives, friends or acquaintances; and
WHEREAS, one in six girls/women and one in thirty-three boys/men will be sexually assaulted in their lifetime;
NOW, THEREFORE, BE IT RESOLVED, by the Pennfield Charter Township Board of Trustees that April, 2009 is recognized as Sexual Assault Awareness Month in the Charter Township of Pennfield. The Pennfield Charter Township Board of Trustees thanks and recognizes Sexual Assault Services of Calhoun County, the Calhoun County Prosecutor’s Office, the Calhoun County Sheriff’s Department and other Law Enforcement and Service Agencies, who, through their cooperative efforts have coordinated the events of Sexual Assault Awareness Month.

CRIME VICTIMS’ RIGHTS WEEK
WHEREAS, President Ronald W. Reagan first declared “National Crime Victims’ Rights Week” in 1981 to focus our Nation’s attention on the plight of crime victims; and
WHEREAS, since 1981, America has joined together annually to recognize the needs and rights of crime victims and survivors during National Crime Victims’ Rights Week;

WHEREAS, the week of April 26-May 2, 2009 has been designated as National Crime Victims’ Rights week with the theme of “25 Years of Rebuilding Lives: Celebrating the Crime Victims’ Rights Act”; and
NOW, THEREFORE BE IT RESOLVED, by the Pennfield Charter Township Board of Trustees that April 26-May 2, 2009 is recognized as Crime Victims’ Rights Week in the Charter Township of Pennfield. The Pennfield Charter Township Board of Trustees thanks and recognizes those victims of crime, the Calhoun County Prosecutor’s Office, the Calhoun County Sheriff’s Department and other law enforcement and service agencies, who, through their cooperative efforts in coordinating the events of Crime Victims’ Right Week, help heighten awareness of the plight of those who are or become a victim of crime.

CHILD ABUSE PREVENTION MONTH
WHEREAS, the month of April, 2009 has been designated as National Child Abuse Awareness Month; and
WHEREAS, youth between the ages of 12 and 19 experience the highest rate of violent victimization in the United States; and
WHEREAS, of the approximately 906,000 children found to be victims of child maltreatment, 63 percent were neglected, 19 percent were physically abused, 10 percent were sexually assaulted and 8 percent were psychologically maltreated; and
WHEREAS, approximately 1500 children died of abuse or neglect in 2006; 79 percent of the children were younger than 4 years of age; and
NOW, THEREFORE BE IT RESOLVED, by the Pennfield Charter Township Board of Trustees that April, 2009 is recognized as Child Abuse Prevention Month in the Charter Township Pennfield. CITIZEN/PUBLIC COMMENT
Two residents spoke; one spoke about the removal of trees blocking the vision of drivers on Gorsline and Bellevue Roads; the other spoke about wanting a variance on a burning permit.
ADDITIONS/DELETIONS
There were no additions or deletions to the Agenda. It was moved by Trustee Bartlett and supported by Trustee Bordine-Houseman to accept the agenda as presented. Motion carried.

It was moved by Trustee Bartlett and supported by Trustee Bordine-Houseman to approve the Consent Agenda consisting of the following items:

DEPARTMENT REPORTS
POLICE: Lt. Eddy gave the police report for the month of March, 2009. The stats are as follows:
There were 130 traffic citations, 01 verbal warnings, 16 traffic crashes, 73 arrests, 93 self generated complaints, 263 dispatched complaints and 728 property inspections.
FIRE: Chief Smith gave the fire report. The stats for the month of March are as follows: There were 78 calls for the month broken down as follows: 13 fire, 45 rescue & emergency service incidents, 8 hazardous condition (no fire), 4 service calls, 5 good intent calls and 3 false alarms. There were two drills for the month.

NEW BUSINESS
1) It was moved by Trustee Bartlett and supported by Trustee Bordine-Houseman to approve of the Identity Theft Prevention Program (Utilities Division/Red Flag Rules). Motion Carried.

PENNFIELD CHARTER TOWNSHIP RESOLUTION #09-24
(A Resolution replacing Resolution #09-19 setting the hourly rate for Paid on Call Fire Fighters to begin April 1, 2009 and continue until changed.)
BE IT RESOLVED, that the Pennfield Charter Township Board hereby sets the hourly rate for Paid on Call Fire Fighters as follows:

PAYMENT OF BILLS
It was moved by Trustee Bartlett and supported by Trustee Bordine-Houseman to approve the payment of the monthly bills in the amount of $434,602.44 (see addendum). Motion carried.
CITIZEN/PUBLIC COMMENTS
Two residents spoke; one about recycling televisions and the other on better speed control on Pine Lake Road.
TOWNSHIP BOARD COMMENTS
Clerk Case announced the upcoming Election on May 5, 2009 and remember to VOTE.
ANNOUNCEMENTS BY CHAIR
Supervisor Behnke recognized 3 Scouts from Troop 374 attending the meeting to earn a merit badge: Jacob Yeager, Ben McCloud and Colorado Taylor.
The next regular Board Meeting will be held on May 12, 2009. The Township office will be closed on Monday May 25th for Memorial Day. The next recycling weekend will be April 25th and 26th. It was moved by Trustee Bartlett and supported by Trustee Bordine-Houseman to adjourn the meeting at 7:39 PM. Motion carried.

Addendum A – Department Reports
UTILITIES REPORT
There were 1,200 meter reads for the month of March, 2009. The stats for the month of March were as follows: 12 works orders for repair/install meters, radio read boxes & repair wires, 20 Miss Digs. The monthly bacterial samples came back negative for the month.
ASSESSOR/ZONING
All Homestead and Property affidavits were suspended until the conclusion of the March Board of Review. 2009 final reports were delivered to the County Equalization Department.
CODE ENFORCEMENT
The Department published in the Battle Creek Shopper News as required by Ordinance in order to enforce during the month of May – October. Property inspections for blight and zoning violations were conducted. There were 16 complaints/violations for the month as follows:

00 – tall grass & weeds
01 – front yard parking
00 – parking/storage of recreational type vehicles
