REGULAR MEETING MINUTES

FEBRUARY 10, 2009

7:00 PM

Supervisor Behnke called the meeting to order at 7:00 PM at the Pennfield Middle School Cafeteria. Present were Supervisor Behnke, Clerk Case, Treasurer Phillips and Trustees Bartlett, Beard, Bordine-Houseman and Ensign. There were 9 residents present. A moment of silence was observed and Supervisor Behnke led the Pledge of Allegiance.

PRESENTATIONS/PROCLAMATIONS

None

CITIZEN/PUBLIC COMMENT

Supervisor Behnke opened the floor for public comment. There was no public comment.

ADDITIONS/DELETIONS TO THE AGENDA

It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to accept the agenda as presented. Motion carried.

CONSENT AGENDA

It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to approve the Consent Agenda consisting of the following items:

1) Regular Board Meeting Minutes of January 13, 2009

2) Utilities Division Monthly Report (see Addendum A)

3) Code Compliance Monthly Report Monthly Report (see Addendum A)

4) Permits Department Monthly Report (see Addendum A)

DEPARTMENT REPORTS

POLICE: Lt. Eddy asked to be excused from the meeting. No report was given. A report will be provided on the Township Website.

FIRE: Chief Smith gave the fire report. The stats for the month of January are as follows: There were 72 calls for the month broken down as follows: 3 Fire, 56 Rescue & Emergency Medical Service Incidents, 4 Hazardous Condition (no fire), 1 Service Call, 3 Good Intent Calls, 5 False Alarm & False Calls. There were two drills for the month.

There was no unfinished business.

NEW BUSINESS

1) ADOPTION OF:

PENNFIELDCHARTER TOWNSHIPRESOLUTION #09-02

(A Resolution urging Governor Granholm to call a special election to fill the vacant 19th District State Senate Seat)

WHEREAS, the 19th District State Senate seat is vacant since State Senator Mark Schauer was sworn into the United States Congress in January, 2009, and

WHEREAS, the State of Michigan continues to face economic crises only made worse by economic challenges in the nation as a whole, and

WHEREAS, the citizens of the 19th District deserve to be represented in the debates about how to meet these crises, and

WHEREAS, Governor Granholm has the authority to call a special election to fill the vacant 19th District State Senate seat, so

THEREFORE BE IT RESOLVED, that the Pennfield Township Board hereby urges Governor Granholm to call a special election as soon as possible to fill the vacant 19th District State Senate Seat.

2) ADOPTION OF:

PENNFIELDCHARTER TOWNSHIPRESOLUTION #09-03

(A Resolution authorizing the Township Supervisor to enter into a lease agreement with NuWave Technology Partners for the purchase of a new telephone system for the Township Office, the Township Permits Department, the Township Utilities Department and the Township Fire Department)

WHEREAS, the current telephone system used by Pennfield Township is now twenty (20) years old (purchased in January, 1989 for about $15,000.00), and

WHEREAS, parts for these telephones are no longer available (the Comdial ExecuTech telephone is no longer manufactured), and

WHEREAS, the current telephone system lacks voice mail, caller ID, as well as the ability to transfer calls between the Township Office and the Township Fire Department, and,

WHEREAS, the Pennfield Township Board recognizes the need for a reliable and efficient telephone system that is designed for today as well as tomorrow, so

THEREFORE BE IT RESOLVED, that the Pennfield Township Board hereby authorizes the Township Supervisor to enter into a three (3) year lease agreement at 0% interest with NuWave Technology Partners for the purchase of a new telephone system for the Township Office, the Township Permits Department, the Township Utilities Department and the Township Fire Department in an amount not to exceed $400.00 per month with a $3,000.00 down payment, and

FURTHER BE IT RESOLVED, that the monthly cost, as well as the down payment, will be spread proportionately between the Township Office, the Township Utilities

3) It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to approve of the SPARTAN STORES Special Land Use Permit (operation of a drive-thru Pharmacy at 1603 Capital Avenue, N.E.) A voice vote was taken and Motion was approved.

TREASURER’S REPORT

January, 2009 Treasurer’s report shows the following balances on hand:

It was moved by Trustee Bordine-Houseman and supported by Trustee Bartlett to receive and place on the file Treasurer’s report. Motion carried.

PAYMENT OF BILLS

It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to approve the payment of the monthly bills in the amount of $101,699.36 (see Addendum).

Motion carried.

CITIZEN COMMENTS

Supervisor Behnke opened the floor for public citizen comment. There was none.

TOWNSHIP BOARD COMMENTS

Treasurer Phillips announced that the deadline for payment of Winter taxes is February 17, 2009 at 4:00 p.m.

The next regular Board Meeting will be held on March 10, 2009. It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to adjourn the meeting at 7:35 p.m. Motion carried.

Addendum A – Department Reports

Meeting Minutes 2-10-09

UTILITIES REPORT

There were 1,200 meter reads for the month of January, 2009. The stats for the month of January were as follows: 7 work orders for repair/install meters, radio read boxes & repair wires, 12 Miss Digs. The monthly bacterial samples came back negative for the month.

ASSESSOR/ZONING

All Homestead and Property Transfer Affidavits are current. There were 5 transfers of property processed as follows: 2 market sales and 3 foreclosure related sales.

CODE ENFORCEMENT

The Department conducted property inspections for blight and zoning violations. There were 5 complaints/violations for the month as follows:

0 - Junk, trash & rubbish

2 - Inoperable vehicles

0 - Tall grass & weeds

2 - Front yard parking

0 - Parking/storing of vehicles & RVs

1- Unsafe structure

0 - Township Ordinance

0 - Zoning Ordinance

PERMITS

The following permits were issued for the month of January, 2009:

Electrical 2 permits (PE08-054 & PE09-001)

Mechanical 7 permits (PM09-001 thru PM09-007)
