CHARTER TOWNSHIP OF PENNFIELD
REGULAR MEETING MINUTES
November 12, 2008
7:00 P.M.
Supervisor Behnke called the meeting to order at 7:00 p.m. at the Pennfield Middle School Cafeteria. Present were Supervisor Behnke, Clerk Bammer, Treasurer Phillips and Trustees Bordine-Houseman, Ensign and Newman; excused was Trustee Bartlett. There were 14 citizens present. Supervisor Behnke asked for a Moment of Silence and asked Mr. Rosberg to lead the Pledge of Allegiance.
PRESENTATIONS
National Drunk and Drugged Driving (3D)
Prevention Month December 2008
WHEREAS, motor vehicle crashes involving alcohol (with at least
one driver with a blood alcohol concentration of .08 g/cL or above accounted
for 32% of all motor vehicle traffic fatalities in 2007 (killing 12,998 persons
and injuring hundreds of thousands more every year in the United States); and
WHEREAS, the December holiday season is traditionally one of the most deadly times of the year for alcohol-impaired driving; and
WHEREAS, according to the National Highway Traffic Safety
Administration, based on the current rates, three in every
ten Americans will be involved in an alcohol related crash
at some point in their lives; and
WHEREAS, organizations across the nation are joining together
To promote the “Drunk Driving. Over the Limit. Under Arrest.”
national public awareness campaign and law enforcement
initiatives in December, 2008, especially between December
13th and December 31st;
NOW, THEREFORE, BE IT RESOLVED, that the CHARTER TOWNSHIP
OF PENNFIELD proclaims December, 2008 as “National Drunk and Drugged Driving Awareness Month” and encourages promotion of the awareness campaigns this December holiday season and throughout the year.

PUBLIC COMMENT/PETITIONS
Supervisor Behnke opened the floor for public comment. There were two residents that spoke:
1) Is the Rail Road going to do anything about the crossing at McAllister Rd. –Not this year.
2) Questions on the agenda.
ADDITIONS/DELETIONS TO THE AGENDA
It was moved and seconded by (Phillips/Houseman) to accept the agenda as presented. Motion carried.
CONSENT AGENDA
It was moved and seconded by (Phillips/Houseman) to approve the Consent Agenda consisting of the following items:
1) Regular Board Meeting Minutes of October 14, 2008.
2) Receive and place on file the following Monthly Reports. (See addendum A)
(a) Utilities Division
(b) Assessor
(c) Code Compliance
(d) Permits Department
3) Accept the Letter of Resignation from Russ Wicklund as Pennfield Township Planning/Zoning Administrator. *It was requested by Trustee Newman to move this item to the first item under new business.
4) Appoint Perry Beard to the Zoning Board of Appeals as the Board Representative effective November 20, 2008.
Motion carried.
DEPARTMENT REPORTS
POLICE:
The stats for the month of October 2008 are as follows: there were 299 calls for service, 78 Traffic Citations, 43 Verbal warnings, 26 Traffic crashes, 69 Arrests, 55 Self-generated complaints, 299 Dispatched complaints, 920 Property inspections.
FIRE:
Chief Smith gave the fire report. The stats for the month of October 2008 are as follows: there were 68 runs for the month; 3 Fire, 51 Rescue & EMS, 2 Hazardous Conditions (No fire), 3 Service calls, 5 Good Intent calls, 4 False Alarm & False Calls.
Training:
There were two drills for the month.

It was moved and seconded by (Phillips/Houseman) to accept with regrets the letter of resignation from Russ Wicklund as the Planning/Zoning Administrator. Motion carried.
PENNFIELD CHARTER TOWNSHIP RESOLUTION #08-45
(A resolution eliminating the annual salary compensation and
benefits for the position of Deputy Supervisor effective
November 9, 2008)
BE IT RESOLVED, that the Pennfield Township Board hereby agrees to eliminate the annual salary compensation of $7,140.00 as well as benefits (FICA and retirement) for the position of Deputy Supervisor from the Township General Fund budget effective November 9, 2008.

PENNFIELD CHARTER TOWNSHIP RESOLUTION #08-46
(A resolution changing the compensation level for Township
Supervisor Rob Behnke as well as the assigning of additional
responsibilities)
WHEREAS, Supervisor Rob Behnke will fulfill the duties of Township Supervisor
on a full-time basis, and
WHEREAS, his previously established salary was $37,904.00, and
WHEREAS, the Township Board agrees that Supervisor Behnke’s compensation
should be changed reflective of Supervisor’s Behnke’s decision to serve as
Township Supervisor on a fulltime basis, and
WHEREAS, state statute (MCL 41.96) allows the Township Board to authorize extra
compensation to township officers for additional (extra) services not otherwise
provided by law, and
WHEREAS, Supervisor Behnke has expressed a willingness to fulfill these positions
in exchange for additional compensation for the position of Planning/Zoning Administrator (previously held by Mr. Russ Wicklund) and Website
Administrator (previously held by Ms. Dee Dee Halder), so

THEREFORE BE IT RESOLVED, that the Pennfield Supervisor’s salary shall be increased to $45,578.00 effective November 9, 2008, and
BE IT FURTHER RESOLVED, that the Pennfield Township Board hereby assigns the following responsibilities as well as compensation and benefits for each of these responsibilities effective November 9, 2008 and with the understanding that Supervisor Rob Behnke will fulfill all of these responsibilities as a full-time employee of Pennfield Township:
Planning/Zoning Administrator $310.00 per week
Website Administrator $133.00 per week

(A resolution establishing the millage rate for the Pennfield Charter Township for Fiscal Year 2008-2009)
WHEREAS, Pennfield Charter Township Boardheld a Truth in Taxation hearing on
March 27, 2008 in accordance with Public Act No. #05 of the 1982 Truth in
Taxation and
WHEREAS, the Pennfield Charter Township Board did approve the establishment of a
Township Tax levy for all real and personal property at the maximum allowable
millage rate for 2008 as approved by the voters in Pennfield Charter Township, so
THEREFORE, BE IT RESOLVED, that the Pennfield Charter Township Board hereby establishes a proposed millage rate of 3.9361.

PENNFIELDCHARTER TOWNSHIPRESOLUTION #08-48
(A resolution to adopt a Street lighting ad Valorem assessment/millage
rate for Fiscal Year 2008-2009)
WHEREAS, it has been the policy of the Pennfield Charter Township Board to levy a special ad Valorem assessment/millage rate against those properties within two hundred feet of a street light, or within a street lighting district, and
WHEREAS, it has been projected by the Pennfield Charter Township Board that the cost for the operation of street lights will be approximately $75,689.55 in 2008, and
WHEREAS, the taxable value of those properties is projected to be $122,771,710 for 2008, so
THEREFORE, BE IT RESOLVED, that the Pennfield Township Board hereby places a special ad Valorem assessment against all properties within two hundred feet of a street light, or within a street lighting district, in the amount of .6166 mills. This ad Valorem assessment shall become part of the 2008 Winter Tax Roll.

It was moved and seconded by (Phillips/Houseman) to introduce Pennfield Charter Township Ordinance #104G-12-08, an Ordinance to amend sections of Appendix B of the Pennfield Charter Township Code of Ordinance with respect to zoning. Motion carried.

It was moved and seconded by (Houseman/Bammer) to receive and place on file the Treasurer's Report. Motion carried.
It was moved and seconded by (Phillips/Houseman) to approve the payment of the monthly bills in the amount of $324,800.63. (See addendum).
PUBLIC COMMENT:
There were three residents that spoke:
-Best Wishes to Julia.
-Would like to have copies of the packet.
TRUSTEES PERSONAL PRIVILEGE:
Clerk Bammer said I have served the Township with 30 years service. Ten of those as General Office and Deputy Clerk and 20 years as Township Clerk, thanks to the voters. It truly has been a wonderful experience.
The next regularly scheduled meeting will be held on December 9, 2008.
November 27 & 28 Thanksgiving - Township will be closed.
