CHARTER TOWNSHIP OF PENNFIELD

REGULAR MEETING MINUTES

October 14, 2008

7:00 P.M.

Supervisor Behnke called the meeting to order at 7:00 p.m. at the Pennfield Middle School Cafeteria. Present were Supervisor Behnke, Clerk Bammer, Treasurer Phillips and Trustees Bartlett, Bordine-Houseman, Ensign and Newman. There were 11 citizens present. Supervisor Behnke asked for a Moment of Silence and led the Pledge of Allegiance.

PUBLIC COMMENT/PETITIONS/PRESENTATIONS:

PROCLAMATION

To designate the month of October, 2008 as

“DOMESTIC VIOLENCE AWARENESS MONTH”

WHEREAS, the month of October, 2008 has been designated as Domestic Violence

Awareness Month; and

WHEREAS, in the United States a woman is beaten every 15 seconds, and

WHEREAS, in 2007, Calhoun County Law Enforcement Agencies responded to 2,566

calls for service involving Domestic Violence: and

WHEREAS, in 2006, 745 felony and misdemeanor arrest warrants involving Domestic

Violence were issued by the Calhoun County Prosecutor’s Office.

NOW, THEREFORE, BE IT RESOLVED, by the Charter Township of Pennfield that October, 2008 is recognized as Domestic Violence Awareness Month. The Charter Township of Pennfield thanks and recognizes those victims of Domestic Violence, the staff and volunteers at S.A.F.E. Place Domestic Violence Shelter, members of the Calhoun County Domestic Violence Coordinating Council, the Calhoun CountyProsecutor’s Office, the Officers and Staff of the Calhoun County Sheriff’s Department, all Law and Enforcement Agencies and Service Agencies, who, through their cooperative effort in coordinating the events of Domestic Violence Awareness Month, have helped to bring attention to the issues surrounding Domestic Violence, to educate our communities regarding Domestic Violence and to prevent the occurrence of Domestic Violence.

IN WITNESS WHEREOF, I, Robert P. Behnke, Supervisor of the Charter Township of Pennfield, have hereunto set my hand and affixed the Seal of the Charter Township of Pennfield, Michigan this 14th day of October, 2008.

Supervisor Behnke introduced Talia Champlin, Chairman of the Advisory Committee for the group called Project 20/20 Informing & Engaging the Battle Creek Area.

Supervisor Behnke introduced Terry Mulvihill who gave a brief update to the Board on the services AT&T will be offering through the franchise agreement. For

CITIZENS COMMENTS:

There were two citizen's comments:

- Regarding the railroad tracks at McAllister Road - the gates go down when there are no trains coming.

- Chris Simmons spoke on behalf of Congressman Tim Walberg.

ADDITIONS/DELETIONS TO THE AGENDA:

It was moved and seconded by (Bordine-Houseman/Ensign) to accept the agenda as presented. The motion carried.

CONSENT AGENDA

It was moved and seconded by (Bordine-Houseman/Ensign) to approve the Consent Agenda consisting of the following items:

1) Regular Board Meeting Minutes of September 9, 2008

2) Receive and place on file the following Monthly Reports. (See addendum A)

(a) Utilities Division

(b) Assessor

(c) Code Compliance

(d) Permits Department

3) Approval of the Battle Creek Lions Club request (Fund Drive October 24 and 25, 2008. Motion carried.

DEPARTMENT REPORTS:

POLICE:

Lt. Eddy gave the monthly report for September 2008. There were no stats for the month of September; the report will be in next month’s packet.

 

FIRE:

Chief Smith gave the fire report. The stats for the month of September 2008 are as follows: there were 74 calls for the month; 5 Fire, 52 Rescue & EMS, 11 Hazardous Conditions (No fire), 3 Service calls, 3 Good Intent calls, 1 False Alarm & False Call.

Training:

There were two drills for the month.

UNFINISHED BUSINESS:

There was no unfinished business.

PENNFIELD CHARTER TOWNSHIP RESOLUTION 08-44

(A resolution to Create and Provide for a Downtown Development

Authority)

WHEREAS, the Pennfield Township Board has determined that it is necessary for the best interests of the public to halt property value deterioration and increase property tax valuation where possible in its business district, to eliminate the causes of that deterioration and to promote economic growth; so

NOW THEREFORE BE IT RESOLVLED, that the Pennfield Township Board hereby declares its intention to create and to provide for the operation of a Downtown Development Authority as allowed by PA 197 of 1975, and

BE IT FURTHER RESOLVED, that December 16, 2008 shall be the date set for the holding of a public hearing on the adoption of a proposed ordinance creating the Authority and designating the boundaries of the downtown district and that this public hearing will be held at 6:00pm at the Pennfield Middle School cafeteria, and

BE IT FURTHER RESOLVED, that the downtown district subject to the jurisdiction of the downtown development authority is hereby tentatively designated to be the area describedinExhibit A attached hereto, and

STILL FURTHER BE IT RESOLVED, that the Township Clerk is hereby authorized and directed to cause notice of said public hearing to be published, posted and mailed, all in accordance with PA 197 of 1975.

It was moved and seconded by (Bordine-Houseman/Ensign) to approve the PA 116 application submitted by Brad & Monica and Mark & Sara Crandall for parcels 13-18-007-151-00 (White Rabbit Road) and 13-18-007-157-00 (22035 North Avenue). A roll call vote was taken as follows:

September 2008, Treasurer's report shows the following balances on hand:

It was moved and supported by (Bordine-Houseman/Ensign) to receive and place on file the Treasurer's Report. Motion carried.

It was moved and seconded by (Bordine-Houseman/Ensign) to approve the payment of the monthly bills in the amount of $147,191.62. (See addendum). Motion carried.

PUBLIC COMMENTS:

Supervisor Behnke opened the floor for public comment which there was none.

 

TRUSTEES PERSONAL PRIVILEGE:

 

November 4th there will be a General Election.

The next regular meeting will be held on Wednesday, November 12, 2008.

The Office will be closed the following dates in November:

Veterans Day Tuesday, November 11, 2008

Thanksgiving, Thursday and Friday, November 27 & 28, 2008

 

It was moved and supported by (Bordine-Houseman/Ensign) to adjourn the meeting at 8:00 p.m. Motion carried.
