CHARTER TOWNSHIP OF PENNFIELD
REGULAR MEETING MINUTES
October 9, 2007
7:00 P.M.

Supervisor Behnke called the meeting to order at 7:00 p.m. at the Pennfield Township Huntington Hall.  Present were Supervisor Behnke, Clerk Bammer, Treasurer Phillips and Trustees Bartlett, Bordine-Houseman, Ensign and Newman.  There were 11 citizens present.  Supervisor Behnke asked for a Moment of Silence and led the Pledge of Allegiance. 

PUBLIC COMMENT/PETITIONS/PRESENTATIONS:
 
PROCLAMATION To designate the month of October, 2007 as “DOMESTIC VIOLENCE AWARENESS MONTH”

WHEREAS, the month of October, 2007 has been designated as Domestic Violence Awareness Month; and

WHEREAS, in the United States a woman is beaten every 15 seconds, and

WHEREAS, in 2006, Calhoun County Law Enforcement Agencies responded to 2,566 calls for service involving Domestic Violence: and

WHEREAS, in 2006, 745 felony and misdemeanor arrest warrants involving Domestic Violence were issued by the Calhoun County Prosecutor’s Office.

NOW, THEREFORE, BE IT RESOLVED, by the Charter Township of Pennfield that October, 2007 is recognized as Domestic Violence Awareness Month.  The Charter Township of Pennfield thanks and recognizes those victims of Domestic Violence, the staff and volunteers at S.A.F.E. Place Domestic Violence Shelter, members of the Calhoun County Domestic Violence Coordinating Council, the Calhoun County Prosecutor’s Office, the Officers and Staff of the Calhoun County Sheriff’s Department, all Law and Enforcement Agencies and Service Agencies, who, through their cooperative effort in coordinating the events of Domestic Violence Awareness Month, have helped to bring attention to the issues surrounding Domestic Violence, to educate our communities regarding Domestic Violence and to prevent the occurrence of Domestic Violence.

IN WITNESS WHEREOF, I, Robert P. Behnke, Supervisor of the Charter Township of Pennfield, have hereunto set my hand and affixed the Seal of the Charter Township of Pennfield, Michigan this 9th day of October, 2007.

ADDITIONS/DELETIONS TO THE AGENDA:
It was moved and seconded by (Bordine-Houseman/Phillips) to add under New Business item #11 (d) Resolution #07-52 to the agenda. Motion carried.
 
CONSENT AGENDA:
 It was moved and seconded by (Bordine-Houseman/Phillips) to approve the Consent Agenda consisting of the following items:

1) Regular Board Meeting Minutes of September 11, 2007
2) Receive and place on file the following Monthly Reports. (See addendum A)
     (a) Utilities Division
     (b) Assessor
     (c) Code Compliance
     (d) Permits Department
3) Approve the Turk Conditional Use Permit extension
Motion carried.
 
DEPARTMENT REPORTS:
 
POLICE:
Lt. Eddy gave the monthly report for September 2007.  The stats for the month of September are as follows: there were 298 calls for service, 194 Traffic Citations, 107 Verbal warnings, 10 Traffic crashes, 155 Arrests, 78 Self-generated complaints, 298 Dispatched complaints, 661 Property inspections. 
 
FIRE:
Chief Smith gave the fire report.  The stats for the month of September 2007 are as follows: there were 67 calls for the month; 1 Fire, 47 Rescue & EMS, 6 Hazardous Conditions (No fire), 3 Service calls, 5 Good Intent calls, 1 False Alarm & False Calls.
 
Training:
There were two drills for the month. 
Apparatus, Equipment and Activities:
Fire Prevention Week Open House -Oct. 11th at the Pennfield High School from 6 to 9 p.m.

UNFINISHED BUSINESS:
There was no unfinished business.

PENNFIELD CHARTER TOWNSHIP RESOLUTION 07-50
(A resolution to adopt a Street Lighting ad valorem assessment/millage rate for Fiscal Year 2007 - 2008)

WHEREAS: it has been the policy of the Pennfield Charter Township Board
to levy a special ad valorem assessment/millage rate against those properties
within two hundred feet of a street light, or within a street lighting district, and

WHEREAS: it has been projected by the Pennfield Charter Township Board that the cost for the operation of streetlights will be approximately $72,092.82 in 2007, and

WHEREAS: the taxable value of those properties is projected to be $118,966,430.00 for 2007, so

THEREFORE, BE IT RESOLVED, that the Pennfield Charter Township Board
hereby places a special ad valorem assessment against all properties within two
hundred feet of a streetlight, or within a street lighting district, in the amount of
.6061 mills.  That this ad valorem assessment shall become part of the 2007
Winter Tax Roll.

PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-51
(A resolution establishing the millage rate for the Pennfield Charter Township for Fiscal Year 2007 - 2008)

WHEREAS: Pennfield Charter Township Board held a Truth in Taxation
hearing on March 27, 2007 in accordance with Public Act No. #5 of
the 1982 Truth in Taxation, and

WHEREAS: the Pennfield Charter Township Board did approve the
establishment of a Township Tax levy for all real and personal property
at the maximum allowable millage rate for 2007 as approved by the voters
in Pennfield Charter Township, so 

THEREFORE, BE IT RESOLVED, that the Pennfield Charter Township Board
hereby establishes a proposed millage rate of 3.9154.

It was moved and seconded by (Bordine-Houseman/Phillips) to set a Special Township Board meeting on Thursday, October 25, 2007 at 7 pm for the Deep Lake Project.  Motion carried.

PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-52
(A resolution to relocate Precinct #1 from Pennfield Central Gym to Grace Community Church and to confirm Precinct #2 and #3  locations)
                                                                        
WHEREAS, the Pennfield Charter Township Board of Trustees under the
recommendation of the Election Commission shall establish the Voting Precincts, and

WHEREAS, the Pennfield Central building has been demolished, and

WHEREAS, the recommendation of the Election Commission for the Voting
Precincts are as follows:

  Precinct #1  Grace Community Church
   9037 Pennfield Road
   Battle Creek, MI 49017

 Precinct #2 Calvary Baptist Church
   1625 Capital Avenue NE
   Battle Creek, MI 49017

 Precinct #3 Pennfield Presbyterian Church
   7979 St. Marys Lake Road
   Battle Creek, MI 49017

THEREFORE, BE IT RESOLVED, that the Pennfield Charter Township Board hereby establishes the three locations listed above will be designated as the Pennfield Charter Township’s official Voting Precincts.

It was moved and supported by (Bordine-Houseman/Phillips) to receive and place on file the Treasurer's Report.  Motion carried.

It was moved and seconded by (Bordine-Houseman/Phillips) to approve the payment of the monthly bills in the amount of $347,283.80. (See addendum).  Motion carried. 

PUBLIC COMMENTS:
Supervisor Behnke opened the floor for public comment and five residents spoke on the following items:
 1)  Please have the street light  at the corner of Capital Ave. NE and White Rabbit Rd. be centered in the intersection.
 2)  What kind of tax base will the Deep Lake project bring to the Township?
 3)  Where will the curb and gutter start and end on North Ave?
 4)  What is the time frame for the completion of the Deep Lake project? 
 5)  Who will pay for the road improvement on Crase Road?

TRUSTEES PERSONAL PRIVILEGE
Open House for Fire Prevention will be Thursday, October 11, 2007. 
There will be a Special Board Meeting Thursday, October 25, 2007. 
November 6th there will be a Special Election for the Bellevue Community Schools.
The next regular meeting will be held on Tuesday, November 13, 2007.
The Office will be closed the following dates in November:
Veterans Day Monday, November12, 2007
Thanksgiving, Thursday and Friday, November 22 & 23, 2007
 
It was moved and supported by (Bordine-Houseman/Phillips) to adjourn the meeting at 7:45 p.m.  Motion carried.
