PENNFIELD CHARTER TOWNSHIP
REGULAR MEETING MINUTES
July 10, 2007

 
Supervisor Behnke called the meeting to order at 7:00 p.m. at the Pennfield Township Huntington Hall.  Present were Supervisor Behnke, Clerk Bammer, Treasurer Phillips and Trustees Bartlett, Ensign, Houseman and Newman.  There were 10 citizens present.  Supervisor Behnke asked for a moment of silence and led the Pledge of Allegiance.
 
PUBLIC COMMENT/PROCLAMATION:
There were two individuals that made comments on the following:
Why is Gary quitting?   Gary is retiring. 
Neighborhood Watch will meet July 12, 2007 at Grace Community Church at 7 pm.  The subject will be Gangs.
  
ADDITIONS/DELETIONS TO THE AGENDA:
It was moved and seconded by (Newman/Ensign) to approve the agenda with the  deletion of item 11f (appointment of an assessor) under New Business.  Motion carried.
 
CONSENT AGENDA:
It was moved and seconded by (Bartlett/ Newman) to approve the Consent Agenda consisting of the following items:

 1) Regular Board Meeting Minutes of June 12, 2007
 2) Receive and place on file the following Monthly Reports. (See addendum A)
     a) Utilities Division
     b) Assessor
     c) Code Compliance
     d) Permits Department
 3) Resolution #07-40 – Support of Smoke Free Worksite/Public Places – (See addendum B)
 4) Appoint Jack Pooler to fill the remainder of Bruce Tuck’s term to the Planning Commission with the term to expire on 12-31-07. 
Motion carried.
 
DEPARTMENT REPORTS:
 
POLICE:

Sgt. Wiersma is the temporary Supervisor of the Pennfield Law Enforcement Team. Sgt. Wiersma gave the monthly report for June 2007.  The stats for the month of June are as follows: there were 270 calls for service, 164 traffic citations, 180 verbal warnings, 6 traffic crashes, 80 arrests, 43 self generated complaints, 270 dispatched complaints, 728 property inspections. 
 
FIRE:

Chief Tim Smith gave the fire report.  The stats for the month of June are as follows: there were 62 fire runs for the month; Fires 2, Rescue & EMS 43, Hazardous Conditions
(No fire) 5, Service calls 8, Good Intent calls 3, False Alarm & False Calls 1.
Training: There were two drills for the month.   

PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-41
       (A resolution awarding a contract to Stetler Built Homes, Inc. for the
       construction of a new addition to Fire Station #1 in an amount not to
       exceed $208,513.00)

BE IT RESOLVED, that the Pennfield Charter Township Board agrees to award a
       contract to Stetler Built Homes, Inc. in the total amount of $208,513.00 for
       the construction of a new addition to Fire Station #1, and

FURTHER BE IT RESOLVED, that awarding of this agreement is conditioned on
the signing of attached agreement, as prepared by the Township Attorney, between Pennfield Township and Stetler Built Homes, Inc.

STILL FURTHER BE IT RESOLVED, that said agreement must be signed by
       Stetler Built Homes, Inc. no later than Thursday, July 21, 2007.

PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-42
       (A resolution approving the financing of the construction of a new
 addition to Fire Station #1 in the Amount of $223,800.00)

BE IT RESOLVED, that the Pennfield Charter Township Board hereby agrees
         to finance the construction of the new addition to Fire Station #1 with Baystone
         Financial in an amount not to exceed $223,800.00 for a fifteen (15) year period
         which represents a construction cost of $208,513.00 and a contingency fund of
         $15,287.00, and

FURTHER BE IT RESOLVED, that the first payment due Baystone Financial will
         not occur prior to April 1, 2008, and

STILL FURTHER BE IT RESOLVED, that the Township Board hereby directs the
        Township Executive Committee (Supervisor Behnke, Treasurer Phillips and Clerk
        Bammer) to complete all necessary paperwork on behalf of the township for this
        financing package.

 PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-43
 (A resolution approving the re-financing of current agreement
   with Baystone Financial on Fire Department vehicles)

BE IT RESOLVED, that the Pennfield Charter Township Board hereby agrees to
 approve the re-financing of the current agreement with Baystone Financial
 for the purchase of the new rescue rig and the new aerial/pumper truck for  
 a ten (10) year period reducing the yearly payment, beginning in April of
 2008, from $93,672.38 to $81,021.43 and

FURTHER BE IT RESOLVED, that the Township Board hereby directs the Township Executive Committee (Supervisor Behnke, Treasurer Phillips and Clerk Bammer) to complete all necessary paperwork on behalf of the Township for this re-financing package.

PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-44
 (A resolution not opposing the proposed abandonment of a portion
  of Harding Avenue)

WHEREAS, the Charter Township of Pennfield has received a petition from the
 residents along a proposed abandonment of Harding Avenue, and

WHEREAS, the Township Board has no objections to the proposed abandonment, so

BE IT RESOLVED, that the Pennfield Charter Township Board hereby states it’s non-
 opposition to the proposed abandonment of 247.5 feet of Harding Avenue which
 is immediately north off of Calvin Road known as the property between Lots 78
 and 79 of Ackley Acres, Section 20, Pennfield Township, and

FURTHER BE IT RESOLVED, that the Township Board reserves the right to obtain,
 if necessary, a utilities easement on said abandoned property.

It was moved and seconded by (Newman/Ensign) that the Township Board approves the agreement with Russ Wicklund of PREIM, Inc. as our Township Zoning Administrator, under the duties and responsibilities as listed under Section 19.01 of Pennfield Township Zoning Ordinance, at a cost of $250.00 per week effective July 30, 2007.  Motion carried.

It was moved and seconded by (Bartlett/Newman) that the Township Board receive the petition as submitted and that we set a public hearing for Tuesday, August 14, 2007 at 6:30 pm, to hear protests against the creation of a special assessment district for the purpose of covering the cost of paving Daugherty Drive (which will be approximately $10, 374.29, or $2,100.00 per property) and to direct the Township Clerk to provide notice of such of public hearing (10) days prior to the public hearing to those property owners along Daugherty Drive.  Motion carried.

It was moved and seconded by (Bartlett/Ensign) to approve the “Engineering Amendment E-1” with CEI, Inc. for the Wal-Mart project at an amended Site Plan Review fee of $17,000.00.  Motion carried.

TREASURER’S REPORT:
Treasurer’s Report shows the balances on hand for June 30, 2007.

It was moved and seconded by (Newman/Ensign) to receive and place on file the Treasurer’s report.  Motion carried.

It was moved and seconded by (Bartlett/Houseman) to approve the payment of the monthly bills in the amount of $270,003.64.  (See addendum C). 

PUBLIC COMMENT:
 
Four individuals spoke on the following items:
 
Wished that Wal-Mart would start building sooner.
 What is the total cost for the new fire trucks?
 Start a five year plan for capital outlay items.
 Will the new fire truck have any influence on our insurance rates?    
  
TRUSTEES PERSONAL PRIVILEGE:
Thanks to Chief Smith and Supervisor Behnke for all of the thorough information on the building expansion. Work is being done to get the property tax information and more pictures of the community on the Website.
 
The next regularly scheduled Board Meeting will be held on August 14, 2007.
(REMINDER: A public hearing will be held at 6:30 pm prior to the August 14th meeting.)

Addendum A – Department Reports
Meeting Minutes 7-10-07
 
UTILITIES:
Over 1,200 meter reads for the month of June 2007.  The stats for the month of June were as follows: 34 Miss Digs, 7 read boxes repaired, and 3 meters repaired.   Water samples for the month came back OK.
 
ASSESSOR/ZONING:
All of the deeds, property transfers, property splits and Homestead Exemptions are current.  There were site plan reviews for 5 zoning permits and 3 building permits.  
 
Zoning:
         
The Zoning Board of Appeals met on June 4th to review a variance request from Tamara Wilde at 20914 East Avenue North.  The variance request was for setback of covered colonnade from 10 feet to 0 feet for unattached structures and relief of side yard set back from 50 feet to 17 feet for principal dwelling.  Request was denied.  The Wilde’s have until July 2, 2007 to bring building into compliance.  
Planning:

The Planning Commission did not meet this month.
 
CODE ENFORCEMENT

Conducted 79 property inspections for blight and zoning violations. 
     
      ¨ There were 34 complaints/violations for the month of June as follows:

      - 09 Unlicensed and or inoperable vehicles.
      - 00 Unsafe structure.
      - 06 Front yard parking/storing of vehicles & RVs.

Addendum B – Resolution #07-40
Meeting Minutes 7-10-07

                  PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-40
 (A resolution in Support of Smoke-Free Worksites and Public Places)

WHEREAS, according to the U.S. Surgeon General, secondhand smoke exposure causes disease and premature death in children and adults who do not smoke, and

WHEREAS, scientific evidence indicates that there is no risk-free level of exposure to secondhand smoke, and

WHEREAS, secondhand smoke is the second leading cause of preventable death in the country, and

WHEREAS, secondhand smoke has been proven to cause cancer, heart disease, stroke, emphysema, and asthma, and

WHEREAS, studies show that children are especially vulnerable to secondhand smoke, suffering more respiratory problems, ear infections, and asthma, as a result of exposure to it, and

WHEREAS, worksites and public places are locations where children, members of the community, and employees are exposed to secondhand smoke, and

WHEREAS, involuntary exposure to secondhand smoke is a serious public heath hazard that is preventable by adopting regulatory policies, and

WHEREAS, it is the responsibility of the Calhoun County Public Health Department to protect the public health of the citizens of Calhoun County pursuant to Public Act 368 of 1978, the Public Health Code, and

WHEREAS, the Calhoun County Board of Commissioners has the authority to enact regulations to eliminate secondhand smoke from public places and worksites, so

BE IT RESOLVED, that the Charter Township of Pennfield herby encourages the Calhoun County Commissioners to consider adopting a Clean Indoor Air Regulation to protect the community from the dangers of secondhand smoke.
