CHARTER TOWNSHIP OF PENNFIELD PUBLIC FORUM March 27, 2007 6:00 P.M.
Supervisor Behnke called the Public Forum to order at 6:00 p.m. at the Pennfield Township Hall. Present were Supervisor Behnke, Clerk Bammer, Treasurer Phillips and Trustees Bartlett, Bordine-Houseman, Ensign and Newman. Also present were 13 citizens.
The purpose of the Public Forum was to inform the residents of the new Bill 480. Supervisor Behnke stated that on January 1st, 2007, PA 480 (Uniform Video Services Local Franchise Act) became effective in the State of Michigan. This Act was vigorously opposed by both the Michigan Municipal League (MML) and the Michigan Townships Association (MTA). The Township will have a small window of opportunity to adjust the current franchise fee with Comcast Cablevision from 3% to 5%. The Township would like to use the additional funds for road repairs. This year the road repair expense is coming from the general fund money.
Supervisor Behnke opened the floor for public comments. Eight residents spoke. They felt that the repair of roads was a great idea; however, one did not feel that the franchise fees should be used for road repairs. No one spoke against the adjustment of the franchise fee. Supervisor Behnke called the meeting to order at 7:00 p.m. at the Pennfield Township Huntington Hall. Present were Supervisor Behnke, Clerk Bammer, Treasurer Phillips and Trustees Bartlett, Bordine-Houseman, Ensign and Newman. Also present were 13 citizens. Supervisor Behnke gave the Prayer and led the Pledge of Allegiance.
PUBLIC HEARING Supervisor Behnke called the Public Hearing to order at 7:03 p.m. at the Pennfield Township Huntington Hall. The purpose of the public hearing was to hear comments on the Township Budget and the Truth in Taxation/Fiscal Year Budgets for 2007/2008. 1) General Fund Budget $1,908,395.00 2) Building Inspection Budget $ 67,759.00 3) Water Budget $ 381,644.00 4) Sewer Budget $ 693,557.00 Page Two Meeting Minutes 3-27-07 Cont. The entire budget has been accessible in the Township Office for public viewing during normal business hours. Supervisor Behnke closed the public hearing at 7:06 p.m. Supervisor Behnke resumed the Special Board Meeting at 7:06 p.m. CITIZEN COMMENTS: Supervisor Behnke opened the floor for Citizens Comments. Four individuals spoke in regard to: Wal-Mart, Fire Chiefs vacation time and asked to move 3 items forward on the agenda.
ADDITIONS/DELETIONS TO THE AGENDA: It was moved and seconded by (Phillips/Bordine-Houseman) to accept the agenda as presented. Motion Carried.
CONSENT AGENDA: It was moved and seconded by (Phillips/Bordine-Houseman) to approve the meeting minutes of March 13, 2007 (budget workshop/Regular Board Meetings). Motion Carried.

PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-24 (A Resolution authorizing the Charter Township of Pennfield, in conjunction with the Calhoun County Road Commission, to spend an amount not to exceed $24,000.00 to repair local roads in Pennfield Township for 2007)
BE IT RESOLVED, that the Pennfield Charter Township Board agrees to pay the Calhoun County Road Commission up to $24,000.00 to repair the following roads in Pennfield Township through a 50/50 match with the Calhoun County Road Commission for 2007:
1.) East Avenue North between White Rabbit Road and Poorman Road ($12,974.09) 2.) Burrows Road between Clear Lake Road and Walkinshaw Road ($7,848.33) 3.) Clear Lake Avenue ($7,971.97) 4.) Clear Lake Road from North Walkinshaw Road to Lynch Road ($7,387.27) 5.) Community Drive ($11,384.85)
BE IT FURTHER RESOLVED, that the paving of Daugherty Drive be included in the 2007 construction year at a projected cost of $10,374.29 to those property owners along Daugherty Drive as long as 51% of the property owners agree with the cost.

PENNFIELD CHARTER TOWNSHIP RESOLUTION 07-25 (a Resolution Authorizing a study for Sanitary Sewer along Capital Avenue)
WHEREAS, it is the desire of the Pennfield Township Board to determine the feasibility and cost associated with extending the current sanitary sewer line from Alvena Avenue to the Pennfield Township Hall to service those businesses currently located along the Capital Avenue Corridor, as well as those future businesses which develop along the same corridor, so
THEREFORE, BE IT RESOLVED, that the Pennfield Charter Township Board hereby authorizes the Township Supervisor to sign an agreement with CEI, Inc. to develop a sanitary sewer study along the Capital Avenue corridor between Alvena Avenue and Pennfield Road in an amount not to exceed $5,500.00.

PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-26 (A Resolution authorizing the Charter township of Pennfield to adjust the current franchise fee from 3% to 5% as permitted under Section VIII of the current agreement with Comcast Cablevision)
WHEREAS, the adoption of Michigan Public Act 480 has given little opportunity for local municipalities to negotiate with cable services doing business in their jurisdiction, and
WHEREAS, Comcast Cablevision could enter into the new standardized agreement as created by the Michigan Public Service Commission which would render the current agreement between the Charter Township of Pennfield and Comcast Cablevision null and void, and

WHEREAS, Comcast Cablevision, or any future video services vendor, would not be obligated to negotiate with the Charter Township of Pennfield as of May 1, 2007, and
WHEREAS, the Charter Township of Pennfield believes that its now appropriate to adjust the current 3% franchise fee with Comcast Cablevision to 5% before the use of the standardized agreement, by Comcast Cablevision or any other video services vendor, locks the franchise fee for the next ten (10) years, and
WHEREAS, the Township Board recognizes the need to repair local roads within Pennfield Township over the next five (5) to ten (10) years, and
WHEREAS, the other local municipalities in the Battle Creek area already have a 5% franchise fee with Comcast Cablevision, so
THEREFORE, BE IT RESOLVED, that the Pennfield Charter Township Board hereby agrees to adjust the current franchise fee with Comcast Cablevision from 3% to 5% effective no later that July 1, 2007, and that all revenues retained by Pennfield Township above and beyond the original 3% shall be dedicated to local road repairs in Pennfield Township for the next five (5) years.
NOW, THEREFORE, BE IT RESOLVED, if this resolution is to change, the Township Board must hold a Public Forum and a new resolution presented.

PENNFIELD CHARTER TOWNSHIP RESOLUTION 07-12 (a Resolution establishing the General Appropriations Act for the Pennfield Charter Township)
WHEREAS: Pennfield Charter Township wishes to establish a General Appropriations Act for Pennfield Charter Township; to define the powers and duties of the Pennfield Charter Township officers in relation to the administration of the budget; and to provide remedies for refusal or neglect to comply with the requirements.
The Board of Trustees of Pennfield Charter Township resolves:
Section 1: Title This resolution shall be known as the Pennfield Charter Township General Appropriations Act.
Section 2: Chief Administrative Officer The Supervisor shall be the Chief Administrative Officer and shall perform the duties of the Chief Administrative Officer enumerated in this act.
Section 3: Fiscal Officer The Clerk shall be the Fiscal Officer and shall perform the duties of the Fiscal Officer enumerated in this act.
Section 4: Public Hearings on the Budget Pursuant to MCLA 42.26, notice of a public hearing on the proposed budget was published in a newspaper of general circulation on Thursday March 15, 2007 and a public hearing on the proposed budget was held on Tuesday, March 27, 2007.
Section 5: Estimated Revenues Estimated township general fund revenues for fiscal year 2007-2008, including an allocated millage of 1 mil; voter authorized millage of 3 mills; and various miscellaneous revenues shall total $1,908,395.00.
Section 6: Millage Levy The Pennfield Charter Township Board shall cause to be levied and collected the general property tax on all real and personal property within the township upon the current tax roll an amount equal to 4 mils as authorized under state law and approved by the electorate.
Section 7: Estimated Expenditures Estimated township general fund expenditures for fiscal year 2007-2008 for the various township activities per the attached budget.

Section 8: Adoption of Budget by Reference The general fund budget of Pennfield Charter Township is hereby adopted by reference, with revenues and activity expenditures as indicated in Section 5 and 7 of this act.
Section 9: Adoption of Budget by Cost Center The Board of Trustees of Pennfield Charter Township adopts the 2007-2008 fiscal year general fund budget by cost center. Township officials responsible for the expenditures authorized in the budget may expend township funds up to, but not to exceed, the total appropriation authorized for each cost center and may make transfers among the various line items contained in the cost center appropriation. However, no transfers of appropriations for line items related to personnel or capital outlay may be made without prior board approval by budget amendment.
Section 10: Appropriation Not a Mandate to Spend Appropriations will be deemed maximum authorizations to incur expenditures. The fiscal officer shall exercise supervision and control to ensure that expenditures are within appropriations, and shall not issue any town order for expenditures that exceed appropriations.
Section 11: Periodic Fiscal Reports The fiscal officer shall transmit to the board at the end of each of the first three quarters, and at the end of each month occurring during the fourth quarter, a report of financial operations, including, but not limited to: a) A summary statement of the actual financial condition of the general fund at the end of the previous quarter. b) A summary statement showing the receipts and expenditures and encumbrances for the previous quarter and for the current fiscal year to the end of the previous quarter; c) A detailed list of: 1) Expected revenues by major sources as estimated in the budget; actual receipts to date for the current fiscal year compared with actual receipts for the same period in the prior fiscal year; the balance of estimated revenues to be collected in the current fiscal year; and any revisions in revenue estimates resulting from collection experience to date. 2) For each cost center; the amount appropriated; the amount charged to each appropriation in the previous quarter for the current fiscal year and as compared with the same period in the prior fiscal year; the unencumbered balance of appropriations; and any revisions in the estimate of expenditures.
Section 12: Limit on Obligations and Payment No obligation shall be incurred against, and no payment shall be made from any appropriation account unless there is a sufficient unencumbered balance in the appropriation and sufficient funds are or will be available to meet the obligation.

Section 13: Budget Monitoring Whenever it appears to the Chief Administrative Officer or the Township Board that the actual and probable revenues in any fund will be less than the estimated revenues upon which appropriations from such funds were based, and when it appears that expenditures shall exceed an appropriation, the Chief Administrative Officer shall present to the township board recommendations to prevent expenditures from exceeding available revenues or appropriations for the current fiscal year. Such recommendations shall include proposals for reducing appropriations, increasing revenues, or both.
Section 14: Violations of this Act Any obligation incurred or payment authorized in violation of this resolution shall be void and shall subject any responsible official(s) or employee(s) to disciplinary action as outlined in P.A.621 (1978) and the Pennfield Charter Township personnel manual.

REQUESTS/DISCUSSIONS/ANNOUNCEMENTS BY THE CHAIR:
The Pennfield Charter Township would like to partner with the Pennfield Schools for marketing the Township and the School.
Dr. Dale Kimball said that the school would be running fiber optic lines to both Purdy School and North Penn and would like to share those lines with the Township Office at no cost to the Township.
Next Regular Board Meeting will be Tuesday, April 10, 2007.
