PENNFIELD CHARTER TOWNSHIP
REGULAR BOARD MEETING
and
INTERVIEWS for SUPERVISOR
January 9, 2007
4:30 P.M.

 Clerk Bammer called the meeting to order at 4:30 p.m. at the Pennfield Township Huntington Hall.  Present were Clerk Bammer, Treasurer Phillips and Trustees Bartlett, Behnke and Newman.  Trustee Ensign was excused.  There were 46 citizens present.

 It was moved and seconded by (Bartlett/Behnke) to have Treasurer Phillips serve as president pro tem.  Motion carried.

 Treasurer Phillips stated that the Township Board would be conducting interviews with the following five individuals, and that Trustee Bartlett would be asking the eight prepared questions.

 President pro tem Phillips asked for a short recess at 6:35 pm.

 The meeting was called back to order at 6:40 pm.   There was discussion among the Board Members as to who would be the best choice to fill the vacancy of Supervisor.

It was moved and seconded by (Bartlett/Bammer) to appoint Robert P. Behnke Jr. to fill the unexpired term of Supervisor of Pennfield Charter Township, to be effective January 29th, 2007 with the expiration date of November 20th, 2008.  A roll call vote was taken:

 President pro tem Phillips asked for a short break at 6:47 pm.

 President pro tem Phillips called the meeting back into session at 7 pm. at the Pennfield Township Hunting Hall.  Treasurer Phillips offered the prayer and Sandy Jones led the Pledge of Allegiance.

 CITIZENS COMMENTS/PETITIONS/PRESENTATIONS
 President pro tem Phillips opened the floor for citizen's time and three people spoke:  Congratulations to Mr. Behnke for being chosen Supervisor; The McAllister Road Bridge is very dangerous, after the Road Commission took off the super structure and the guard rail is 4inches low. 
 
ADDITIONS/DELETIONS TO THE AGENDA:
  It was moved and seconded by (Bartlett/Behnke) to accept the agenda as presented.   Motion carried.

  CONSENT AGENDA
     It was moved and seconded by (Bartlett/ Behnke) to approve the Regular Board Meeting Minutes of December 12, 2006, and to receive and place the Department Reports on file.   Motion carried.

DEPARTMENT REPORTS:
SHERIFF DEPARTMENT:
Lt. Eddy gave the monthly report for December 2006.  The stats for the month of December are as follows: there were 226 calls for service, 166 Traffic Citations, 184 Verbal warnings, 23 Traffic crashes, 74 Arrests, 72 Self-generated complaints, 226 Dispatched complaints, 824 Property inspections.
 
FIRE:
There were 71 Fire runs for the month of December 2006.  Monthly stats: 6 fires, 44 rescue & EMS, 17 hazardous conditions (no fire), 2 service calls, 2 good intent calls.

UTILITIES:
Over 1,200 meter reads for the month of December 2006.  There were 40 Miss Dig calls.  Water samples for the month came back OK.  The High School and Middle School hooked up to our water system over the Christmas break.

 ASSESSOR/ZONING:
All of the deeds, property transfers, property splits and Homestead Exemptions are current.  The County completed their study for the different classes: agricultural, residential, and developmental and our records are complete.   Personal Property Statements were printed and mailed.
Zoning:
          The Zoning Board of Appeals did not meet in December.
Planning:
          The Planning Commission met December 4, 2006 and approved the Wal-Mart Final Site Plan contingent upon final approval by Randy Ramsey for engineering and storm water requirements and new prints providing photometric plan and updated property lines.

 CODE ENFORCEMENT
Conducted 34 property inspections for blight and zoning violations.  There were 4 complaints/violations for the month of December as follows:
 
· 03 violations for junk, trash & rubbish
· 00 violations for unlicensed and or inoperable vehicles.
· 00 violations for unsafe structure.
· 00 violations for front yard parking.
· 01 violation of zoning or Township ordinance.
· 00 violations for overgrown grass.
· 00 violations for building without permit.
Completed and submitted Annual Report for National Pollutant Discharge Elimination System (NPDE)

It was moved and seconded by (Bartlett/Behnke) to authorize the Township Treasurer to collect the 2007 summer taxes for the following entities: Pennfield Schools, Harper Creek Schools, CISD and Kellogg Community College.  Motion carried.

It was moved and seconded by (Bartlett/Behnke) to authorize Fire Chief Smith to replace or purchase uniforms for the full and part time firefighters at a cost not to exceed $2,700.00.

 PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-01
(A resolution appointing and reappointing members to the Area Metropolitan Services Agency (AMSA) Electrical Board).

BE IT RESOLVED, that the Pennfield Charter Township Board hereby officially
adopts the recommendation of the following individuals to be appointed to
the Electrical Board of Appeals for the designated terms:

  PENNFIELD CHARTER TOWNSHIP RESOLUTION #07-02
(A resolution to dissolve the respective duties of the AMSA Plumbing, Mechanical, Electrical and Building Boards of their respective duties assigned to the AMSA Construction Board of Appeals pursuant to
Section 14 of the Act.)

WHEREAS, the State Construction Code Act, 1972 PA 230, as amended (hereinafter referred to as the “Act”), requires each governmental unit to provide a Construction Board of Appeals consisting of at least three and not more than seven members if said governmental unit has elected to enforce the Act or any section thereof or any rules promulgated there under; and,

WHEREAS, the purpose of the Construction Board of Appeals is to hear appeals from the denial of applications for building permits as well as from any other decision by an enforcing agency pursuant or related to the Act or the Construction Code thereby eliminating the need for separate Plumbing, Mechanical, Electrical and Building Boards of Appeals; and,

Cont. Resolution #07-02

WHEREAS, the members of the Area Metropolitan Service Agency (“AMSA”) have all individually assumed responsibility for administration and enforcement of the State Construction Code Act throughout their respective corporate limits; and,

WHEREAS, the Urban Cooperation Act, 1967 PA 7, provides that governmental units may jointly exercise any power, privilege or authority which such agencies might exercise separately; and,

WHEREAS, AMSA has been organized by the City of Battle Creek, the City of Springfield, the Charter Township of Bedford, the Charter Township of Emmett, the Charter Township of Pennfield, the Township of Leroy, and the Township of Newton to promote uniformity, efficiency, and sharing of services provided by the governmental units in the Greater Battle Creek area;

NOW, THEREFORE, be it resolved that the AMSA Plumbing, Mechanical, Electrical and Building Boards are hereby dissolved and their respective duties assigned to the AMSA Construction Board of Appeals pursuant to Section 14 of the Act.

 It was moved and seconded by (Bartlett/Behnke) to receive and place on file the Treasurer's Report.  Motion carried.

 It was moved and seconded by (Bartlett/Behnke) to approve the payment of the monthly bills in the amount of $420,755.56 (See addendum #1).  Motion carried.

PUBLIC COMMENT:

 Two people spoke: Has the Township received the packet from the Calhoun County Road Commission?  Congratulations to Rob  on his appointment to the position of Supervisor.
 
 TRUSTEE’S PERSONAL PRIVILEGE:

 It was moved and seconded by (Bartlett/Behnke) that the Pennfield Township advertise for the vacant Trustee position for Letters of Intent in the February 1st Battle Creek Shopper with a deadline of Thursday, February 8th.  Motion carried.
 
REQUESTS/DISCUSSIONS/ANNOUNCEMENTS BY THE CHAIR:

 The next regularly scheduled meeting will be held on February 13, 2007.
 It was moved and seconded by (Bartlett/Behnke) to adjourn the meeting at 7:30 p.m.  Motion carried.
