PENNFIELD CHARTER TOWNSHIP

REGULAR MEETING MINUTES

JUNE 8, 2010

Supervisor Behnke called the meeting to order at 6:30 pm at the Pennfield Middle School

Cafeteria. Present were Supervisor Behnke, Clerk Case, Treasurer Phillips, Trustees

Bartlett, Beard, Bordine-Houseman and Ensign. There were nine residents present.

Supervisor Behnke led the Pledge of Allegiance.

CITIZEN PUBLIC COMMENTS (AGENDA ITEMS ONLY)

None

ADDITION/DELECTIONS TO AGENDA

There were no additions or deletions to the agenda. It was moved by Treasurer Phillips and supported by Trustee Beard to accept the agenda as presented. Motion carried.

CONSENT AGENDA

It was moved by Treasurer Phillips and supported by Trustee Beard to approve the Consent

Agenda. Motion carried. The Consent Agenda consists of the following items:

1) Meeting Minutes of May 11, 2010

2) Utilities Division monthly report (see Addendum A)

3) Code Compliance monthly report (see Addendum A)

4) Permits Department monthly report (see Addendum A)

5) Assessors Department monthly report (see Addendum A)

DEPARTMENT REPORTS

POLICE: Lt. Steve Eddy from the Calhoun County Sheriff’s Department was present to give the monthly report. The stats for the month are as follows: 242 traffic citations, 158 verbal warnings, 10 traffic crashes, 65 arrests, 92 self generated complaints, 304 dispatched complaints and 1,380 property inspections.

FIRE: Chief Tim Smith gave the fire report for the month of May, 2010. The stats are as follows:

There were 68 calls: 2 fires, 50 rescue & emergency, 6 hazardous conditions (no fire), 6 good intent calls and 1 false alarm.

NEW BUSINESS

1. It was moved by Treasurer Phillips and supported by Trustee Beard to adopt Pennfield Charter Township Ordinance No. 81B-06-10 of 2010. Motion carried.

ORDINANCE NUMBER 81B-06-10 OF 2010

AN ORDINANCE TO AMEND CERTAIN SECTIONS OF THE PENNFIELD CHARTER TOWNSHIP CODE WITH RESPECT TO THE PURCHASE, CONSUMPTION OR POSSESSION OF ALCOHOLIC LIQUOR BY MINORS.

SECTION 1. Section 34-151 of the Pennfield Charter Township Code is hereby amended to read as follows:

Section 34-151: Purchase, consumption, or possession of alcoholic liquor by minor; attempt; furnishing fraudulent identification to minor.

(1) - (5) unchanged

(6) A public safety officer or peace officer may arrest a minor based in whole or in part upon the results of a preliminary chemical breath analysis. The results of a preliminary chemical breath analysis or other acceptable blood alcohol test are admissible in a criminal prosecution to determine whether the minor has consumed or possessed alcoholic liquor.

(7) - (12) unchanged

SECTION 2. SEVERABILITY OF INVALID PROVISIONS. If any provision of this Ordinance shall be held invalid, its invalidity shall not effect any other provisions of this Ordinance that can be given effect without the invalid provision, and for this purpose the provisions of this Ordinance are hereby declared to be severable.

SECTION 3. REPEAL. All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect.

SECTION 4. SAVINGS CLAUSE. A prosecution which is pending on the effective date of this ordinance and which arose from a violation of an ordinance repealed by this ordinance, or a prosecution which is started within one (1) year after the effective date of this ordinance arising from a violation of an ordinance repealed by this ordinance and which was committed prior to the effective date of this ordinance, shall be tried and determined exactly as if the ordinance had not been repealed.

SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect on the date of publication pursuant to MCL 42.22; MSA 5.46(22), which publication shall take place within thirty days from the date of adoption and shall be in a local newspaper of general circulation.

2. Pennfield Charter Township Resolution #10-33

PENNFIELD CHARTER TOWNSHIP RESOLUTION 10-33

(a Resolution to correct a portion of Township Board Resolution 08-41 with respect to the Health Reimbursement Arrangement payment through United Healthcare)

BE IT RESOLVED, that the Pennfield Township Board hereby adopts the following deductible and reimbursement amounts associated with our health insurance program (United Healthcare):

1) Employees with SINGLE coverage and a $1,000.00 deductible will receive

up to $750.00 from United Healthcare once they have satisfied the first $250.00 of their annual deductible amount.

2) Employees with EMPLOYEE/SPOUSE coverage and a $2,000.00 deductible will receive up to $1,500.00 from United Healthcare once they satisfied the first $500.00 of their entire annual deductible amount.

3) Employees with FAMILY coverage and a $3,000.00 deductible will receive up to $2,250.00 from United Healthcare once they satisfied the first $750.00 of their entire annual deductible amount.

June, 2010 report shows the following balances on hand:

It was moved by Trustee Bordine-Houseman and supported by Trustee Beard to receive and place on file the Treasurer’s report. Motion carried.

PAYMENT OF BILLS

It was moved by Treasurer Phillips and supported by Trustee Beard to approve the payment of the monthly bills in the amount of $194,973.24. Motion carried.

CITIZEN/PUBLIC COMMENT

Guest speaker, Mike Jaconette spoke. He is running for Calhoun County Probate Judge. He introduced himself and spoke on his campaign.

TOWNSHIP BOARD COMMENTS

Discussion took place on the demolition of homes and garages on the dangerous buildings list.

Treasurer Phillips stated that tax bills will be going out on July 1st. Clerk Case announced that the Clerk’s office is getting ready for the Primary Election on August 3rd.

ANNOUCEMENTS MADE BY THE CHAIRPERSON

The next Township Board meeting is scheduled for July 13, 2010. The next recycling weekend is June 26th and 27th. The Township office will be closed Friday, July 2nd and Monday, July 5th for the Fourth of July holiday. It was moved by Treasurer Phillips and supported by Trustee Beard to adjourn the meeting at 7:39 pm. Motion carried.

ADDENDUM A – DEPARTMENT REPORTS

UTILITIES

There were 1,200 meter reads for the month of May, 2010. The stats for the month are as follows:

10 corrective work orders (repair/install meters, radio read boxes, repair wires) and 24 Miss Digs.

The monthly bacterial sample came back negative.

ASSESSOR/ZONING

The following was accomplished for the month of May, 2010:

1) All Homestead & Property Transfer Affidavits are current. There were 5 transfers of property processed for the month as follows: 1 foreclosure transfer, 2 foreclosure re-sales, and 2 regular market sales. 2) Conducted miscellaneous phone & in person inquiries about assessments and descriptions. 3) Resumed photo project of residential properties.

CODE ENFORCEMENT

The following was accomplished for the month of May, 2010:

1) Conducted property inspections for new complaints and follow up inspections of previous complaints. Contractor mowed, trimmed, removed grass clippings and removed junk from eight properties. Received 43 complaints for the month as follows:

8 – junk, trash and rubbish

1 – inoperable vehicle

34 – grass

PERMITS

26 permits were issued for the month of May, 2010 as follows:

Building 9 permits (PB10-018-PB10-026) $1,957.67

Electrical 7 permits (PE10-003-PE10-022) $1,095.00

Mechanical 2 permits (PM10-026-PM10-027) $265.00

Plumbing 4 permits (PP10-010-PP10-013) $745.00

Zoning 4 permits (PZ10-004-PZ10-007) $200.00

TOTALS: $4,262.67
