REGULAR MEETING MINUTES

MAY 11, 2010

Supervisor Behnke called the meeting to order at 6:30 pm at the Pennfield Middle School

cafeteria. Present were Supervisor Behnke, Clerk Case, Treasurer Phillips, Trustees Bartlett, Beard, Bordine-Houseman and Ensign. There were six residents present. Supervisor Behnke led the Pledge of Allegiance.

ADDITIONS/DELETIONS TO AGENDA

There were no additions or deletions to the agenda. It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to accept the agenda as presented. Motion carried.

CONSENT AGENDA

It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to approve the Consent Agenda. Motion carried. The Consent Agenda consists of the following items:

1) Meeting Minutes of April 13, 2010

2) Utilities Division monthly report (see Addendum A)

3) Code Compliance monthly report (see Addendum A)

4) Permits Department monthly report (see Addendum A)

5) Assessors Department monthly report (see Addendum A)

6) Termination of POC Firefighter Lt. Brian Cornwell

DEPARTMENT REPORTS

POLICE: Lt. Steve Eddy from the Calhoun County Sheriff’s Department was present to give the monthly report. The stats for the month are as follows: 204 traffic citations, 166 verbal warnings, 11 traffic crashes, 79 arrests, 73 self generated complaints, 261 dispatched complaints and 1195 property inspections. He also stated that Deputy

Luis Rivera, who is assigned to the Pennfield Team was notified that he is the recipient of the Police Officers Association of Michigan Officer of the Year.

FIRE: Chief Smith gave the fire report for the month of April, 2010. The stats are as follows: There 67 calls: 6 fires, 52 rescue & emergency, 4 hazardous conditions (no fire), 1 good intent call and 4 false alarms.

PENNFIELD CHARTER TOWNSHIP RESOLUTION 10-31

(a Resolution awarding a contract to Seven Brothers Painting, Inc. for the re-painting of the Pennfield Charter Township Water Tower as well as the installation of a new overflow flap gate in the amount of $ 44,900.00)

BE IT RESOLVED,that the Pennfield Township Board hereby directs the Township Supervisor to sign a Notice of Award to Seven Brothers Painting, Inc. in the amount of $44,900.00.

(a Resolution approving an agreement with Dixon Engineering, Inc. for project administration associated with the re-painting of the Pennfield Charter Township Water Tower as well as the installation of a new overflow flap gate in the amount of $ 6,350.00)

BE IT RESOLVED,that the Pennfield Township Board hereby directs the Township Supervisor to enter into an agreement with Dixon Engineering, Inc. for project administration services in the amount of $ 6,350.00.

3. It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to introduce Pennfield Charter Township Ordinance No. 81B-06-10 of 2010. Motion carried.

ORDINANCE NUMBER 81B-06-10 OF 2010

AN ORDINANCE TO AMEND CERTAIN SECTIONS OF THE PENNFIELD CHARTER TOWNSHIP CODE WITH RESPECT TO THE PURCHASE, CONSUMPTION OR POSSESSION OF ALCOHOLIC LIQUOR BY MINORS.

SECTION 1. Section 34-151 of the Pennfield Charter Township Code is hereby amended to read as follows:

Section 34-151: Purchase, consumption, or possession of alcoholic liquor by minor; attempt; furnishing fraudulent identification to minor.

(1) - (5) unchanged

(6) A public safety officer or peace officer may arrest a minor based in whole or in part upon the results of a preliminary chemical breath analysis. The results of a preliminary chemical breath analysis or other acceptable blood alcohol test are admissible in a criminal prosecution to determine whether the minor has consumed or possessed alcoholic liquor.

(7) - (12) unchanged

SECTION 2. SEVERABILITY OF INVALID PROVISIONS. If any provision of this Ordinance shall be held invalid, its invalidity shall not effect any other provisions of this Ordinance that can be given effect without the invalid provision, and for this purpose the provisions of this Ordinance are hereby declared to be severable.

SECTION 3. REPEAL. All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect.

SECTION 4. SAVINGS CLAUSE. A prosecution which is pending on the effective date of this ordinance and which arose from a violation of an ordinance repealed by this ordinance, or a prosecution which is started within one (1) year after the effective date of this ordinance arising from a violation of an ordinance repealed by this ordinance and which was committed prior to the effective date of this ordinance, shall be tried and determined exactly as if the ordinance had not been repealed.

SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect on the date of publication pursuant to MCL 42.22; MSA 5.46(22), which publication shall take place within thirty days from the date of adoption and shall be in a local newspaper of general circulation.

4. It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to extend the current Utilities Division to June 20, 2010. Motion carried.

5. It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to

approve of the promotion for paid on call Firefighter Lt. Richard Smith to Captain. Motion carried.

TREASURER’S REPORT

April, 2010 report shows the following balances on hand:

It was moved by Trustee Bartlett and supported by Trustee Bordine-Houseman to

receive and place on file the Treasurer’s report. Motion carried.

PAYMENT OF BILLS

It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to approve the payment of the monthly bills in the amount of $241,855.24.

CITIZEN/PUBLIC COMMENT

Two citizens spoke: 1) Stated that McAllister Road is in bad condition and asked if the Road Commission could do anything about it. 2) Inquired if Consumers Electric was going to finish the clean-up of tree removal on North Avenue and wants the road sign replaced on North Avenue and White Rabbit Road as it has been knocked down.

TOWNSHIP BOARD COMMENTS

Trustee Bordine-Houseman expressed thanks to Lt. Cornwell for his years of service to the Fire Department. Treasurer Phillips congratulated Officer Rivera on receiving “Officer of the Year” award by the Police Officers Association of Michigan. Clerk Case

gave election results from the May 4th school election and thanked all who voted.

ANNOUNCEMENTS MADE BY THE CHAIRPERSON

Supervisor Behnke also thanked Lt. Cornwell for his years of service to the Fire Department and congratulated Deputy Rivera on being the recipient of the Officer of the Year award. Stated that Wal-Mart has delayed building for another year but we are still on their list for a Super Center. The next Township Board meeting is scheduled for June 8, 2010. The next recycling weekend is May 22nd and 23rd. The Township office will be closed on Monday, May 31, 2010 for Memorial Day.

It was moved by Treasurer Phillips and supported by Trustee Bordine-Houseman to adjourn the meeting at 7:05 pm. Motion carried.

ADDENDUM A – DEPARTMENT REPORTS

UTILITIES

There were 1,200 meter reads for the month of April, 2010. The stats for the month are as follows: 22 corrective work orders (repair/install meters, radio read boxes, repair wires) and 143 Miss Digs. The monthly bacterial sample came back negative.

ASSESSOR/ZONING

The following was accomplished for the month of April, 2010:

1) All Homestead & Property Transfer Affidavits are current. There were nine transfers of property processed for the month: 3 new foreclosures, 3 foreclosure resales and 3 regular market sales. 2) Attended a meeting with the County Assessors, Equalization and STC representatives. 3) Conducted miscellaneous phone & in person inquiries about assessments and descriptions. 4) Resumed photo project of residential properties.

CODE ENFORCEMENT

The following was accomplished for the month of April, 2010:

1) Conducted property inspections for new complaints and follow up inspections of previous complaints. Attended an informal hearing for ticket issued for an inoperable vehicle. Received 15 complaints for the month as follows:

12 – junk, trash and rubbish

2 – inoperable vehicles

1 – Twp Ordinance – storage of travel trailer

PERMITS

19 permits were issued for the month of April, 2010 as follows:

Building 5 permits (PB10-013 thru PB10-017) $1,640.32

Electrical 6 permits (PE10-011 thru PE10-016) $ 680.00

Mechanical 4 permits (PM10-022 thru PM10-025 $ 510.00

Plumbing 3 permits (PP10-007 thru PP10-009) $ 440.00

Zoning 1 permit (PZ10-003) $ 50.00

TOTALS: $3,320.32
